Polygamy Licenses for Civil Servants According to Government Regulation No. 10/1983 Jo Government Regulation No. 45/1990 on Marriage and Divorce Permits for Civil Servants and Law No. 1 of 1974 Concerning Marriage Associated with Islamic Law (Case Study of Decision Number 1098/PDT.G/2011/PA.Mks)

Abstract


Basically, marriage law in Indonesia adheres to the principle of monogamy. But there are some exceptions that are not monogamous. Polygamy is recognized by Indonesian marriage law. In some cases polygamy can be done. In relation to polygamy, two issues arise which will be examined in this paper. First, how polygamy is done without the permission of the wife according to Government Regulation no. 10 of 1983 Jo Government Regulation no. 45 of 1990 and Law no. 1 of 1974 and Islamic law, the second whether the judge's consideration in the decision of the Religious Courts Number 1098/Pdt.G/PA.Mks has been in accordance with applicable legislation. The method used in the writing of this thesis is by using the normative juridical research method, which is an approach method that emphasizes the science of law by means of research on positive law as well as trying to examine the rules of law applicable with analytical descriptive research specifications. Data collection techniques used in this study are literature study and interview. Based on this research can be concluded that polygamy is done without permission from the wife according to Government Regulation no. 10 of 1983 Jo Government Regulation no. 45 of 1990 and Law no. 1 Year 1974 and Islamic law can be canceled for the law, because polygamy is done not in accordance with applicable laws and regulations. The unlicensed marriage of the first wife is not illegal, but because the marriage is not in accordance with the laws and regulations made by the State. Before the law, unauthorized marriage is fine while a polygamous person is able to be fair and able to meet the needs (clothing, food and boards) of his wives and children in the future. Then the Decision of the Religious Courts Number 1098 / Pdt.G/PA.Mks has been in accordance with the applicable law and other laws related to marriage, especially for civil servants.
