The Implementation of DSN Fatwa Number 06/DSN-MUI/IV/2000 on the Istishna Sale and Purchase on the Implementation of Istishna Agreement of Product KPR Indent IB in BTN Syariah Branch Bandung

Abstract

Each product issued by Islamic bank must always be guided by the fatwa that has been set by the National Sharia Board established by the Indonesian Ulema Council. The provisions of DSN-MUI fatwa No.06 / DSN-MUI / IV / 2000 on Sale and Purchase of Istihsna are for them who should have the right stuff khiyar if there are defects or goods not in accordance with customer specifications. In practice Istishna contract in the State Savings Bank Branch Bandung Syari'ah khiyar rights have not been enforced so that is not in accordance with the DSN-MUI fatwa. The purpose of this intensive search is to investigate the implementation of the contract Istishna according DSN-MUI Fatwa No.06 / DSN-MUI / IV / 2000 on the Sale and Purchase Istishna. It was also to investigate the implementation of the contract Indent Istishna on mortgage products in the State Savings Bank Branch Syari'ah Bandung. In addition, it was to determine the application DSN-MUI Fatwa No.06 / DSN-MUI / IV / 2000 on the Sale and Purchase Istishna on the implementation of the contract Istihsna Indent mortgage products in the State Savings Bank Syari'ah Bandung. The method used in this research is descriptive analysis. Data collected by the method of documentation, literature, and interviews. Data obtained through the literature and interview process with banks, developers, and customers, then studied and analyzed. The results show that the provisions DSN-MUI fatwa about the goods have been executed by the State Savings Bank Branch Syariah Bandung. However, nothing related to the payment are not appropriate in terms of payment which only allow payment by money and not by other means of exchange like gold rods, checks or securities in an effort to run the precautionary principle,  as well as their liberation after the maturing debt.
