Juridis Review of Implementation of Criminal Sanctions to Traffickers of Children Traded by Age Referred from Law Number 35 Year 2014 Concerning Amendment to Law Number 23 Year 2002 Regarding Protection of Children Juncto Law Number 21 Year 2007 Regarding The Eradication of Criminal Action Trading Person (Case Study of Decision of PN Bandung Number: 874 / Pid.B / 2015 / PN.BDG)

Abstract

Child trafficking may be qualified as a serious criminal offense and human rights violations. Many cases have been found on employing underage girls (18 years old) and trafficked as commercial sex workers (CSWs). The eradication of criminal acts of trafficking in persons is one of the objectives of the social defense policy, which aims to provide social protection. From cases such as those happening in Bandung, sex offenders who employ children under age as Commercial Sex Workers (CSWs), mostly only applied articles of the Criminal Code. The method used is descriptive research method of analysis means to describe the provisions relating to child trafficking crime under the umut, then in the analysis to obtain clarity with respect to the problem under study and through the normative juridical approach that is in finding the data used with Adhering to the juridical aspects but in addition it also seeks to examine the rules that apply in society and continued with data collection techniques is literature study. From the results of the discussion and analysis in this thesis it can be seen that Law Number 35 Year 2014 About Amendment of Law No. 23 of 2002 on Child Protection several articles that regulate the legal protection for minors employed and trafficked as Sex Workers Commercial (PSK). Then on the imposition of criminal sanctions against perpetrators of criminal acts that trafficking minors for Commercial Sex Workers (CSWs) should not only be based on the Criminal Code, but can be strengthened through Article 82 of Law Number 35 Year 2014 on Amendment to Law Number 23 Year 2002 on Child Protection and article 2 paragraph (1) of Law No.21 of 2007 on Limitation of Trafficking in Persons.
