Kajian Yuridis Pembangunan Pullman Hotel & Convention Hall Kota Bandung Dihubungkan dengan Kewajiban Menyusun Dokumen AMDAL Berdasarkan Peraturan Menteri Negara Lingkungan Hidup Republik Indonesia Nomor 5 Tahun 2012 tentang Jenis Rencana Usaha dan/atau Kegiatan yang Wajib Memiliki Analisi Mengenai Dampak Lingkungan Hidup

Abstract


Every business will have positive and negative impacts. Business activities that have important impacts must be able to guarantee sustainable development. Environmental Impact Assessment (EIA/AMDAL) is one of the preventive measures in order to create sustainable development, therefore any business and/or activity must have EIA document. EIA required for businesses and/or activity has important implications with respect to any construction activity. EIA should be done for every business and/or activities that will be built because of the laws and government regulations requirement. One of the regulations is Act No. 32 of 2009 on the Protection and Environmental Management requires that every business and / or activities that are likely to pose a major and significant impact on the environment must have an EIA.It turned out that in practice many business activities and/or activities or the construction of buildings that meet the criteria of important impacts stance not based on EIA. One of them is construction of Pullman Hotel & Convention Hall Bandung in Bandung Region. Business operators do not take the EIA and Recommendations of the Governor in the development of business plans and/or activities. With the exclusion of the EIA and the governor recommendation could result in impacts that are important to the region. One of them is malfunctions of the environment in North Bandung area. Therefore the issues studied in this study are the Pullman Hotel & Convention Hall of Bandung including the category of activities and development efforts that must require AMDAL as one of its requirements and how the implementation of Pullman Hotel & Convention Hall Bandung construction in practice is associated with the obligation to compile AMDAL documents. This study uses a juridical normative and juridical empirical approach using secondary data made from primary, secondary and tertiary law. The obtained data are analyzed qualitatively. Research specification used is descriptive analysis that describes comprehensively to acquire comprehensive and systematic description of the implementation of AMDAL documents preparation as one of the requirements required for the development of Pullman Hotel & Convention Hall of Bandung. The conclusion of this study states that Pullman Hotel & Convention Hall of Bandung is included in the criteria of business plan and/or activity that requires AMDAL and Recomemendation of the governor. But in terms of implementation has not been implemented properly because Pullman Hotel & Convention Hall of Bandung does not fulfill its obligation to do AMDAL and Recomemendation of the governor.
