The Legal Aspects of Termination Procedures of Living Assisted Therapy for Terminal State Patients Based on the Liabilities of Human Being Protection

Abstract


Discontinuation of therapy can help survival in patients categorized as an act of euthanasia. When viewed in terms stipulated in the Medical Code of Ethics Indonesia, in particular on Article 7d. Thus, the physician must strive to protect and maintain living human beings. This means if the physician ended the life of a patient in a manner violating KODEKI euthanasia. Discontinuation of therapy in patients with a life support action to stop most or all of the life support therapies that have been given to patients with terminal state. The development of the dying make the act of discontinuing therapy live help to do with the stringent conditions that have been determined in PMK No. 37 In 2014, in order to provide legal certainty and protection to patients and their families, health professionals and health care facilities as a patient terminal state that experienced unconsciousness (coma) that not for a moment then discontinuing therapy live help can be done to stop the suffering of patients in the lives quasi with approval of a terminal patient's family. Since all measures of treatment has been futile and even life support therapy was only let patients live quasi rely on tools that basically patients have died. If the doctor retains a ventilator to the patient terminal was pronounced dead, the doctor is considered to have committed abuses against patients for delaying the death of a patient, it is stipulated in Article 351 of the Criminal Code, because doctors considered maltreatment to the patient and the patient's family can demand accountability doctors criminally and demanding compensation for the negligence of doctors who cause harm to their families. Data was collected using a normative juridical research method that is legal research done by researching library materials and secondary data as well as the basis of Islamic law. In this study intended to find secondary data which include the primary legal materials, i.e. materials in the form of a legally binding legislation, such as Law No. 36 Year 2009 on Health, PMK No. 37 of 2014 on the Determination of Death and Utilization of Donor, KODEKI and other regulations that support. Secondary law, which provides an explanation of the primary legal materials include the opinions of jurists, scholarly books, articles papers, research, journals, and literature internet, tertiary legal materials, i.e. materials that give instructions and an explanation of the material primary and secondary law such as legal dictionaries, and encyclopedias.
