Abstract. Members of the United Nations Committee on the Peaceful Uses of Outer Space (COPOUS) create a consesus that eventually gave birth to The Agreement Governing the Activities of States on the Moon and Other Celestial Bodies (the Moon Agreement) to regulate activities that exploit the resources in outer space. As we know that the Moon and the other celestial bodies of our solar system contain a vast amount of natural resources such as aluminum, iron, silicon, chromium, manganese, hydrogen, potassium and helium-3 that is extremely rare on Earth. The use of extraterrestrial resources as a source of energy not only will have tremendous impact but also will have the capability to solve the energy. Mining activities on the Moon is only giving space-faring nation benefit. Therefore, these activities have challenge and opposition from many nations because it does not comply with the provisions in the Moon Agreement, where moon and other celestial bodies is not subject to national appropriation by any claim. By using normative juridical approach, author try to research and study all materials primary and secondary by analyzing the provisions in the Moon Agreement regulates mining activities on the moon and other celestial bodies. This research tries to fill the gap by analyzing the Moon Agreement on regulating the mining and exploitation of extraterrestrial natural resources for commercial purposes and all the benefit of Indonesia to ratify the Moon agreement.

Abstrak. Beberapa negara yang tergabung dalam The United Nations Committee on the Peaceful Uses of Outer Space (COPOUS) membuat sebuah konsesus yang pada akhirnya melahirkan sebuah perjanjian yang diberi nama The Agreement Governing the Activities of States on the Moon and Other Celestial Bodies (the Moon Agreement) untuk mengatur kegiatan eksplorasi dan eksploitasi di Bulan dan benda langit lainnya. Bulan seperti yang kita ketahui kaya akan barang tambang mineral, seperti Almunium, iron, silikon, kromium, mangan, hidrogen, potassium dan helium-3  yang sangat langka di Bumi. Sumber daya alam tersebut dapat dimanfaatkan untuk menghasilkan energi dan digunakan bagi kepentingan manusia di Bumi sekaligus mengatasi krisis energi yang terjadi saat ini. Kegiatan penambangan di Bulan pada dasarnya dilakukan hanya untuk kepentingan Negara yang melakukan penambangan. Hal ini menimbulkan perdebatan dari beberapa negara karena bertentangan dengan ketentuan yang diatur di dalam the Moon Agreement yang menetapkan Bulan dan benda- benda di langit lainnya tidak dapat dijadikan objek kepemilikan. Penelitian ini menggunakan metode pendekatan yuridis-normatif penulis mengkaji bagaimana the Moon Agreement mengatur penambangan di Bulan dan benda langit lainnya dan bagaimana urgensinya bagi Indonesia sebagai negara yang belum aktif dalam kegiatan eksplorasi ruang angkasa.. Penulis juga meniliti dan mempelajari bahan- bahan hukum primer maupun sekunder dengan menganalisa ketentuan- ketentuan yang terdapat dalam The Agreement Governing the Activities of states On The Moon And Other Celestial Bodies 1979 secara kualitatif. Peneitian ini mencoba untuk mengisi kesenjangan tersebut dengan bertujuan menganalisis kegiatan penambangan di Bulan menurut the Moon Agreement dan eksploitasi sumber daya alam di luar bumi untuk tujuan komersial serta keuntungan Indonesia dalam meratifikasi perjanjian the Moon Agreement.
