Non-Government Entities Liability on Space Activities Based on International Space Law with The Implementation in Regarding Part of Falcon 9 Rocket Fall Down in Sumenep Madura.

Abstract


Space activity during this period was already more advanced, this is evidenced by the presence of Non-governmental Entities involved in activities of Space, a Space X is one of the non-governmental entity that existed in the business Space, one of which is the satellite launch services, using the Falcon9 rocket can carry a load equivalent to one large size bus into Earth orbit, but a big accomplishment also followed with great risk for example, on 26 September 2017 a foreign object falling on the area of Sumenep, Madura, the alleged object of the object Space Objects hit the property belongs to the citizens, lucky there were no fatalities in the incident, BPBD and the police immediately secure the Sumenep, and handed over to LAPAN for researched further, based on the 1972 Liability Convention that every country should launch responsible ultimately to loss of activity space that occur in the Earth's surface and a flying aircraft, based on the incident, then the problems in this research are formulated as follows: (1) How setting the responsibility of non-governmental entities in the activities space according to international and national legal space?, (2) how the implementation arrangements are the responsibility of non-governmental entities in the activities of space according to the law space International case against the collapse of part of the rocket Falcon 9 in the area of Sumenep Madura? Researchers using the study review of the literature against the fall of the Falcon9 rocket in sumenep Madura, the result of research it is found that the Government of Indonesia until now has not mechanism of indemnification against the object space, it is generally only in the article about the 76-78 responsibility,79-83 of indemnity act space, that the Government should immediately make clear liability mechanisms in order for that is clear so that future Space Objects Fall events can be handled quickly and effectively
