The Status of The Processed Product Halal Certificate Import Food Published by Lawful Foreign Institutions Not Cooperation with Indonesia Halal Institutions Based on Law No. 33 Of 2014 about Halal Product Warranty

Abstract


The processed food product imports into Indonesia without any halal label in the packaging but have the halal certificate from the country of origin. According to the applicable terms processed product import food required certified halal from Indonesia halal institutions and must be through the certification process first unless the lender halal certificate in the country of origin has a cooperative relationship with local halal certification rating, then the product is enough to register before circulated in the market. Because it could harm the consumer delegated rights Muslims in Indonesia. Mie Samyang is a product of the processed food imports from South Korea that has been circulating since 2013 in Indonesia and is believed to be halal product because it already has halal certificate country of origin and stated by the importer through social media, halal statement from the importers do not have legal certainty about because it must be supported by the label halal. How halal certificate status processed product import food published by the institution of halal origin country that did not develop cooperation with Indonesia halal institutions, and how the actions of the lawful Indonesia against furthermore processed halal product import food that only certified from the country of origin. This research method using descriptive analytical where the author gives images of systematically about facts. Research stage structured leases library research data processing and interview. The research results provide halal certificate status is owned by Samyang Product not yet can be declared as the halal product because between lawful institutions South Korea (KMF) and institutions are lawful Indonesia (MUI) has not an existence of cooperation on the product warranty, halal and importers do not apply for halal certification to MUI. MUI cannot perform related actions Furthermore still samyang products. Because as a local halal certification institution, MUI has limited the authority.
