Equality of The Parties of a Cooperative Agreement Rumah Makan Cibiuk Kajang Reviewed of Generally Franchise Agreement

Abstract


At present, there are various types of agreements, both written and unwritten agreements, an agreements that there is in the regulations is called named agreements, in the fact there is also developing agreements called an unnamed agreements, because the type of agreement in the regulations is not enough for human needs, one of which is franchise agreement. It is currently discussed by the authors is the cooperation agreement in which it resembles a franchise agreement, involving the local and foreign parties and in the agreement there is an inequality between the parties. In this regard, there is an imbalance in the cooperation agreement caused by the use of the principle of freedom of contract by the parties concerned. With that the author wants to analyze these problems by using normative juridiction methods,  specifications of the research is descriptive analysis. The analysis of this issue, will be seen from the clause in the cibiuk restaurant of kajang agreements and The principles of the agreement in general and of the franchise agreement in general. Broadly speaking, in the presence of inequality in the agreement, the position of the parties becomes unbalanced and in fact the agreement must be canceled or rejected from the beginning of the signing.
