Pilot Medical Examination in Order to Consumer Safety Reviewed from International Aviation Regulations and National Aviation Regulations

Abstract


Consumer of aviation services have the right to flight safety. Pilot is one of the aviation personnel that has an important role in supporting flight safety. One of the factors that must be guaranteed by the business actor is that the pilot performs their duties in a healthy state physically and spiritually. To support it, the pilot is required to perform and comply with provisions of medical examination.  There are still many cases of pilots who are not in a good health while going to carry out their duties. This study aims to determine the rules of the flight that regulate consumer rights for aviation safety at international and national levels and how the implementation of pilot health inspection arrangements in order to satisfy the safety of aviation in Indonesia. The study method used is normative juridical method. The research examines the normative regulations concerning aviation safety and Law No.8 of 1999 on Consumer Protection. The research specification used is descriptive analysis. The source of data is using secondary data consisting of primary, secondary, and tertiary legal materials. The data obtained are then analyzed qualitatively. The result of the study show the laws and regulations applicable by International Civil Aviation Organization (ICAO). Implementation of provisions of the medical check on the flight article is conformity with the applicable regulations need to be studied further, as there are still many pilot health cases that are not monitored by existing types of medical examinations.
