The Role of Forensic Otopsy in Discussing The Criminal Acts of Civil Service Cause The Death of Children Connected with The Book of The Criminal Law Of Article 133

Abstract

The role of the forensic autopsy is the evidence in the judiciary, the forensic autopsy issued by the forensic medical scientist in visum et repertum when asked by the investigator to assist the investigation process. Refers on the Article no. 133 Paragraph (1) of the Criminal Code Procedures, that states “in the case of an investigator for the court's interest in handling a victim, whether injured, poisoned or dead suspected to be a criminal offense, he can request for the expert information from judicial medical expert or physician and / or other expertsâ€. The methodology of research used by normative juridical specification that is approach based on main legal material by studying legal theories of Article 133 paragraph (1) Criminal Codes Procedure related by role of forensic autopsy in court. This study is descriptive analysis that has function to obtain a comprehensive and systematic case by legal theories and practice of law implementation concerning the role of forensic autopsy associated with child abuse that led to death.The results revealed on the case of decision No.102 / Pid.B / 2013 / PN.Unh that has didn’t used forensic autopsy for the victim case of Ansar, so the result of case is not clear according to the author's analysis because the causes death of Ansar victims are not knowing.
