Judge Project Implementation Supervision and Observer (Hawasmat) by Undang-Undang Nomor 8 Tahun 1981 about Kitab Undang-Undang Hukum Acara Pidana (Case Study: Women's Correctional Institution Class IIA Bandung)

Abstract

This research purpose is for Implementation Supervision And knowing Observations Conducted by the judge wasmat and constraints in District Court Class IA Bandung on the Women Correctional Institution Class IIA Bandung to collect data in the form Interview with Judge Wasmat of 1 (one) and the Deputy Registrar Criminal Law as much as 1 (one) in District Court Class IA Bandung interviews with three (3) persons Prison staff in Women Correctional Institution Class IIA Bandung Determination Letter (SP) appointment of judges in the District Court Class IA Bandung, questionnaires supervisory judge in the framework of monitoring visits and observation (wasmat) at the Institute for Women correctional class IIA Bandung. Data are obtained through the study of documents and field studies were then analyzed qualitatively. for conducting studies theoretical foundation writer by studying books, scientific papers, articles and legislation relating to the object of research problems who want authors carefully. From the research that the author encountered in the field shows that the implementation of monitoring and observations made by hawasmat of the District Court Class IA Bandung against inmates Women Correctional Institution Class IIA Bandung rated less effective implementation because given the supervision and observation, only 1 (one) time 2016 while on the 28th of December 2016 the authors assess the judge wasmat did not visit but only send a letter to the Penitentiary through to an employee of the court to make a demand for a number of data regarding the number of inmates and the data relating to the assignment of judges wasmat to monitoring and observation in according with the mandate Undang-Undang Nomor 8 Tahun 1981 Tentang Kitab Undang-Undang Hukum Acara Pidana (KUHAP) and Surat Edaran Mahkamah Agung Nomor 7 Tahun 1985 tentang Petunjuk  Pelaksanaan  Tugas Hakim Pengawas  dan  Pengamat. Barriers that occur related to the implementation of tasks Hawasmat based on a number of factors, one of them due to the limited time available for the judge wasmat in performing their duties to supervise and observe inmates in Correctional facility and the number of judges supervisors and observers representing only 1 (one) in the District Court Class IA Bandung.
