The Abuse of Authority by General Dentists Conducting Orthodontist Authority Based on Law of the Republic of Indonesia Number 29 of 2004 on Medical Practice

Abstract

Installation stirrup teeth is one of the health services in the field of dentistry in particular handled by dentists orthodontic specialists. Installation stirrup dental work done because of several factors involving the teeth and bones to prevent malocclusion and dental disease due its function does not work properly. However, the medical action in the installation of dental braces under the authority of orthodontic specialist dentist abused by general dentists. Issues to be discussed in this paper is whether a general dentist in installing stirrup teeth should be an authority of a specialist dentist orthodontic included into acts of abuse of authority, how the relationship mounting stirrup teeth with health measures according to the Law of the Medical Practice and how the legal responsibility of doctors general dental practice outside the authority. The method used is the juridical-normative. Normative juridical-legal approach is to look at the regulations in both the primary legal materials and secondary materials or approaches to problems with the way in terms of the legislation in force. This research was conducted by examining the data and the literature which is a secondary material in the form of legislation, theory, literature, internet, lectures, legal documents relating to the health of the abuse of authority committed by a general dentist. In analyzing the data, the author uses descriptive analytical method that analyzes data describing precisely analyzed in order to clarify an issue. Results from this study showed that general dentists who perform authorized specialist dentist orthodontic included into acts of abuse of authority, which is an effort to preventive health (disease prevention) and general dentists should be held responsible in law is divided into two forms of default and tort. Not only is legally responsible for general dentists should ethically responsible and professional.
